Terms of Service

1. Acceptance of Terms

By accessing or using lyviana.shop ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.

2. Description of Service

Lyviana is an online auction marketplace that connects local buyers and sellers. The Platform facilitates online bidding for physical goods that are collected via local pickup. We are not a party to transactions between buyers and sellers.

3. User Accounts

You must provide accurate information when registering. You are responsible for maintaining the security of your account and all activity that occurs under it. Notify us immediately at support@lyviana.shop if you suspect unauthorized access.

4. Buying

• Bids are binding. If you win an auction, you are obligated to pay the final bid price plus the 5% buyer's premium.
• Payment is processed automatically via PayPal when the auction closes.
• You must pick up your items within the seller's specified window. Failure to do so may result in forfeiture.
• All sales are final unless the item was materially misrepresented.

5. Selling

• You must accurately describe all items. Misrepresentation is grounds for account suspension.
• You are responsible for fulfilling all winning bids within your stated pickup window.
• Lyviana charges a 10% commission (Free plan) or $29/month + 2% (Pro plan) on completed sales.
• Payouts are made via PayPal within approximately 2 business days of auction close.

6. Prohibited Items

You may not list: illegal items, weapons, drugs, stolen property, counterfeit goods, animals, hazardous materials, or any item prohibited by applicable law.

7. Fees

Fees are as described on our Sell page. We reserve the right to update fees with 30 days' notice.

8. Limitation of Liability

Lyviana is not liable for any disputes between buyers and sellers, loss of items during pickup, or any indirect, incidental, or consequential damages. Our total liability to you shall not exceed the fees paid by you in the prior 3 months.

9. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States.
